These Terms of Service ("Terms") govern your access to and use of kaiacom.com and the services provided by kAIacom (the "Services"). kAIacom is a brand operated by CryptaSpace LLC, a company based in Phoenix, Arizona that serves businesses locally and nationwide. By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. The Services

kAIacom provides AI automation and business consulting services for local and nationwide businesses, including but not limited to: AI phone agents, website chatbots, SMS and email follow-up, calendar booking automation, review generation, CRM and pipeline automation, lead scoring, and related consulting, integration, and support services. Specific deliverables, timelines, and pricing are defined in the proposal, statement of work, order form, or written agreement you sign with us.

2. Acceptable Use

You agree to use the Services only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the Services. You agree not to:

• Use the Services to send spam, harassment, illegal content, or unsolicited marketing in violation of TCPA, CAN-SPAM, or other applicable laws
• Upload or transmit viruses, malware, or any malicious code
• Attempt to gain unauthorized access to the Services, related systems, or other users' accounts
• Misrepresent your identity, your business, or your authority to act on behalf of any person or business
• Use the Services in any way that violates TikTok's, Google's, Meta's, or any other platform's terms of service
• Scrape, crawl, or otherwise extract data from the Services at scale without our written permission

3. Your Responsibilities

You are responsible for providing accurate, current, and complete information about your business, your customers, and your use case. You are responsible for reviewing the legality of any messages, scripts, automations, or content we deploy on your behalf, including compliance with TCPA, CAN-SPAM, HIPAA (where applicable), state telemarketing laws, and any industry-specific rules that apply to your business. We are not your lawyer; nothing on kaiacom.com or in our deliverables constitutes legal, tax, accounting, or regulated financial advice.

You are also responsible for maintaining the security of your own accounts, integrations, API keys, and credentials, and for notifying us promptly if you believe an account or integration has been compromised.

4. Authorized TikTok & Third-Party Platform Actions

If we manage a TikTok account, a Meta account, a Google Business Profile, or any other third-party platform on your behalf, we will only publish, post, send, or otherwise act on those accounts after you have explicitly approved the action in writing (email, Slack, or our project management tool is sufficient). You can revoke our authorization at any time and we will stop acting on your behalf.

5. No Guaranteed Results

We do not guarantee any specific revenue, lead volume, search rankings, platform approval, or business outcome from using the Services. AI automation improves speed, follow-up, and consistency, but results depend on many factors outside our control, including your market, offer, sales process, ad spend, seasonality, and the actions of third-party platforms such as TikTok, Google, Meta, and the phone carriers. Testimonials and case studies reflect specific client experiences and are not promises of what you will achieve.

6. Intellectual Property

All content on kaiacom.com — including text, graphics, logos, code, designs, illustrations, and the kAIacom name and marks — is owned by CryptaSpace LLC or its licensors and is protected by US and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, modify, or create derivative works from our content without our prior written permission, except as needed to use the Services as intended.

You retain ownership of the content, data, and materials you provide to us. You grant us a limited, non-exclusive license to use that content as needed to provide the Services to you. We may use anonymized, aggregated learnings from client engagements to improve our Services, but we will not publicly identify you or your business as a reference without your permission.

7. Third-Party Services

The Services rely on third-party providers, including but not limited to:

• TikTok — for authorized social posting, lead forms, and messaging integrations
• Cal.com — for scheduling and booking
• Resend — for transactional and marketing email delivery
• Cloudflare — for hosting, edge delivery, and security
• Payment providers — for invoicing and card processing
• Telephony, SMS, CRM, and other integration partners used to deliver the Services

These third parties have their own terms and privacy policies. We are not responsible for the availability, accuracy, content, or practices of any third-party service. Your use of those services is at your own risk and subject to their respective terms.

8. Limitation of Liability

To the maximum extent permitted by law, kAIacom and CryptaSpace LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost revenue, lost leads, lost data, or business interruption, arising out of or related to your use of (or inability to use) the Services, even if we have been advised of the possibility of such damages. Our total cumulative liability for any claim arising out of or related to the Services will not exceed the amounts you actually paid us for the Services giving rise to the claim in the three (3) months immediately before the event giving rise to the claim.

Nothing in these Terms is intended to exclude or limit any warranty or liability that cannot be excluded or limited under applicable law.

9. Indemnification

You agree to indemnify and hold harmless CryptaSpace LLC and its officers, members, employees, and agents from any claim, demand, loss, liability, damage, or expense (including reasonable attorneys' fees) arising out of your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.

10. Termination

We may suspend or terminate access to the Services at any time if we reasonably believe you have violated these Terms. You may stop using the Services at any time. Paid engagements are governed by the cancellation terms in your signed proposal or order form.

11. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms will be resolved in the state or federal courts located in Maricopa County, Arizona, and you consent to the personal jurisdiction of those courts.

12. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top reflects when they were last revised. Continued use of the Services after a change means you accept the updated Terms.
